If you are screening German territory for future sites, the question that matters first is not "what can I build here today," but "where is this municipality planning to let anything be built at all." That is what the Flächennutzungsplan layer answers, and it is a different question from the one a Bebauungsplan answers. What is a Flächennutzungsplan?
The Flächennutzungsplan (FNP) is the preparatory, municipality-wide tier of German Bauleitplanung, the statutory land-use planning system that runs through the BauGB. Where a Bebauungsplan (B-Plan) draws binding rules for a specific area, the FNP does something broader and earlier: it maps out, across the whole municipal territory, where the municipality intends residential, commercial, industrial and green space to sit over the coming years.
Think of it as the municipality's own long-range intent, drawn on a map. Commercial building areas (Gewerbliche Baufläche), mixed-use areas (Gemischte Baufläche), special-purpose areas (Sonderbaufläche such as large retail), community-facility land (Gemeinbedarfsfläche), green space (Grünfläche) and agricultural land (Landwirtschaftsfläche) all get a designation. None of that is a building permit. It is the municipality telling every future planning process, including its own, where it wants things to go.
That distinction between "planned for the whole territory" and "binding for one site" is the whole reason the two layers exist separately, and it is why reading only one of them gives you half the picture.
What does the Flächennutzungsplan tell you that a Bebauungsplan doesn't?
A Bebauungsplan is legally binding for the specific area it covers. If a plot has a Bebauungsplan designating Gewerbegebiet with a given site coverage ratio and height limit, you know today, with a high degree of certainty, what you may build. That certainty is exactly the B-Plan's value, and exactly its limit: it only exists where a municipality has already gone through the (often multi-year) process of adopting one. Large parts of German territory, including plenty of land that will eventually carry a B-Plan, do not have one yet.
This is where the FNP earns its place in a screening workflow rather than a permitting one. An FNP designation is frequently the earliest public signal that a municipality has decided, in principle, that a given area should become commercial or industrial land, sometimes years before a Bebauungsplan gets drafted for it. A parcel designated Gewerbliche Baufläche in the FNP with no B-Plan yet is not buildable today, but it is a municipality telling you, in writing, where it is heading. A parcel with no FNP designation at all, by contrast, is telling you something too: that no such intent has been recorded.
For a team screening a whole region for future logistics or industrial sites, that is the difference between a shortlist built on public record and a shortlist built on guesswork. The FNP shows land reserves and future commercial areas before anyone else has priced them in.
Is a Flächennutzungsplan legally binding?
Not in the way a B-Plan is, and this is the point at which people most often misread the layer. Under §5 BauGB, the FNP sets out a municipality's intended land use for its whole territory. Under §7 BauGB, public planning bodies must adapt their own plans to it. Both of those obligations run between authorities. Neither one confers a building right on an individual landowner or developer.
If no Bebauungsplan exists for a site, that site is judged under §34 BauGB inside built-up areas (Innenbereich, roughly: land already surrounded by existing development) or §35 BauGB outside them (Außenbereich, undeveloped open land where new building is restricted by design). The FNP does not enter that test. It is not what a building authority checks against when it decides a permit.
So the FNP's value is timing, not certainty. Read as an early indicator of municipal intent, it tells you where to look next. Read as a substitute for a permit check, it will mislead you, because "designated in the FNP" and "permitted to build" are two entirely different statements. Keep that boundary explicit in any workflow that uses this data, and the layer earns its keep; blur it, and you have manufactured false confidence for whoever reads your shortlist next.

Baden-Württemberg, Berlin, Brandenburg, Hamburg, Mecklenburg-Vorpommern, Lower Saxony, Schleswig-Holstein and Thuringia publish it; the other eight do not.
